(ENR) upgrade of the Emmitsburg Wastewater Treatment
Plant (WWTP) including a new headworks facility with
mechanical screening and grit removal; two aeration
lagoons; two secondary clarifiers with a return
activated sludge (RAS) pumping station; a Chemical
and Blower building; denitrification filters;
cascade aeration; flow monitoring; a plant water
pumping station; two aerobic digesters; a dewatering
facility with one centrifuge; a plant recycle
pumping station; and other miscellaneous
improvements, will be received by:

Time) June 12, 2012 and then at said office publicly
opened and read aloud.
A Pre-Bid Conference
will be held on May 9, 2012 at 10:00 a.m. local time
at the Town of Emmitsburg’s office at 300A South
Seton Avenue, Emmitsburg, MD 21727 followed by a
tour of the Emmitsburg WWTP. Representatives of
Owner and Engineer will be present to discuss the
Project.

Copies of the
Bidding Documents may be obtained at the Issuing
Office, the Town of Emmitsburg, Maryland, located at

upon payment of
$200.00 for each set in the form of a check or money
order payable to the Town of Emmitsburg. If mailing
of documents is requested, a separate check payable
to Town of Emmitsburg in the amount of $100.00 per
set must be included to cover handling and postage
fees. No refunds will be made for the return of
plans and specifications.

No response will be
given to questions received less than 14 days before
the bid date.
This project will be
funded in part by the Maryland Water Quality
Financing Administration’s (MWQFA) State Revolving
Loan Fund (SRF) Program and the State ENR Grant
Program.
As a condition of
federal grant awards, regulations require the RLF
recipients (Town of Emmitsburg) and prime
contractors to make a good-faith effort to award a
fair share of work to qualified Disadvantaged
Business Enterprises (DBEs). Bidders must
demonstrate and document the affirmative steps to
provide opportunities DBEs to participate in the
project. For additional information, please visit

The project or
segment thereof to be constructed in accordance with
these contract documents is subject to the following
requirements. In the event of conflict with other
requirements of the contract documents, the
following requirements control unless the
requirement is a minimum requirement. Nothing in
this document shall be construed to prohibit the
owner from requiring additional assurances,
guarantees, indemnities, or other contractual
requirements from any other party to this agreement.
I. REQUIREMENT AND CONTRACT PROVISIONS FOR THE
PROJECT FINANCED THROUGH THE MARYLAND WATER QUALITY
REVOLVING LOAN FUND AND THE MARYLAND DRINKING WATER
REVOLVING LOAN FUND (October 1,2008).
II. THE PREVAILING
FEDERAL WAGE RATES AS DETERMINED BY THE U.S.
DEPARTMENT OF LABOR UNDER THE DAVIS-BACON AND
RELATED ACTS. AVAILABLE AT:

Each bid proposal
must be accompanied by a Bid Bond payable to the
Town of Emmitsburg in the amount of 5% of the Total
Bid Price, the bid bond forms included in the Bid
Proposal Division of the documents being utilized
for this purpose.
If, upon acceptance
of his bid, a Bidder fails to enter into a Contract
with the Town of Emmitsburg, the bid security shall
be forfeited to and become the property of the Town.
No bidder may
withdraw his bid within one hundred twenty (120)
days after the date of the bid opening. The
successful bidder must furnish a 100% Performance
and Payment Bond with a surety company satisfactory
to the Town and conforming to the prerequisite
requirements of Article 5 of the General Conditions.
The Town reserves
the right to waive any informalities or to reject
any or all bids.
Bidders are required
to certify, under penalty of perjury, that bids have
been prepared without collusion with other bidders,
subcontractors, suppliers, etc. This certification
is included with the Bid Proposal which each Bidder
must sign in the space provided.
