Ordinance to Amend
Title 2
Of the Code of Emmitsburg
Entitled Administration and Personnel

Be it resolved, enacted and ordained
by the Mayor and Board of Commissioners of the Town of
Emmitsburg, Maryland, pursuant to the authority granted
to them by the laws of Maryland and the Charter of the
Town of Emmitsburg, that Title 2; Section 2.23.010 of the
Emmitsburg Municipal Code, be amended as follows.
The amended sections of these
regulations reads as follows with new language designated
by being in BOLD CAPITAL LETTERS, and language
being deleted designated by being in strike out.

Chapter 2.12 Town Clerk
2.12.010 Town clerk-Appointment, removal, duties and
responsibilities.
A. There shall be a town clerk appointed by the mayor
with the approval of the board of commissioners. His/her
compensation shall be determined by the board of
commissioners. The administrative and financial
duties of the town, as discussed by this
chapter as well as in the Charter, shall be exercised by
the town clerk under the direct supervision of the town
manager.
B. The town clerk may be removed from office for cause
as outlined in the town's employee handbook. Where
circumstances warrant, the board of commissioners may
give the town clerk thirty (30) days' notice of the
expiration of his/her appointment.
C. Under the supervision of the town manager, the clerk
shall have the authority and shall be required to:
1. Assist the town manager in the preparation of
an annual budget to be submitted by the mayor to the
board of commissioners;
2. Maintain a general accounting system for the town in
such form as the board of commissioners may require, not
contrary to state law;
3. Assist the town manager in the collection of all
taxes, special assessments, license fees, liens, and all
other revenues (including utility revenues) of the town,
and all other revenues for whose collection the town is
responsible, and receive any funds receivable by the
town;
4. Do such other things in relation to the fiscal or
financial affairs of the town as the town manager, mayor
or the board of commissioners may require or as may be
required elsewhere in the Charter or other ordinances.
D. C. The clerk shall record all ordinances as
provided in Section 2.04.010 and shall record all orders
or resolutions passed by the commissioners and publish
them in such manner as the commissioners may direct. The
clerk shall perform all such other duties which may,
from time to time, be assigned to him/her by the mayor
or the board of commissioners.

Be it further resolved, enacted and ordained
that this Ordinance shall take effect on the date on
which the Mayor approves the Ordinance after passing by
the Board of Commissioners or on the date on which the
Board of Commissioners pass the Ordinance over the veto
of the Mayor.

against, 0 absent, and 0 abstain.
